Introduction

These Terms of Service ("Terms") govern your use of the SwiftBid platform and services available at swiftbid.co.uk ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

SwiftBid is operated in England and Wales. These Terms constitute a legally binding agreement between you ("the Client") and SwiftBid ("we", "us", "our").

1. Service Description

SwiftBid provides an AI-powered bid and tender writing service. You upload tender documents and related materials, and our multi-agent AI system analyses requirements, drafts responses, checks compliance, and produces a professionally formatted bid document for your review and submission.

The Service is designed to assist with bid writing. The final submission of any bid or tender response remains your sole responsibility. We do not guarantee that any bid produced using our Service will be successful.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or your organisation. You must notify us immediately of any unauthorised use of your account.

3. Pricing & Payment

Our services are priced on a per-bid basis. Current pricing is displayed on our website and is subject to change. The price applicable to your order is the price confirmed at the time of purchase.

All prices are stated in pounds sterling (GBP) and are exclusive of VAT unless otherwise indicated. Payment is processed securely via Stripe at the time of order. We accept major debit and credit cards.

You agree to provide accurate payment information and authorise us to charge the applicable fees to your chosen payment method.

4. Delivery

Completed bids are delivered electronically via your SwiftBid account dashboard. Delivery timeframes depend on the service tier selected:

• check_circle Basic: AI-generated draft delivered within 24 hours.
• check_circle Standard: full AI agent team output delivered within 24 hours.
• check_circle Premium: AI plus human expert review delivered within 48 hours.

Delivery times are estimates and are not guaranteed. We will make reasonable efforts to meet stated timeframes and will notify you of any significant delays.

5. Revisions Policy

Each bid order includes one (1) free revision. A revision request must be submitted within 7 days of the original delivery and must relate to the original scope and requirements of the bid.

Additional revisions beyond the included allowance, or revisions that materially change the scope of the original brief, may be subject to additional charges at our standard rates.

6. Refund Policy

We offer a 7-day money-back guarantee. If you are not satisfied with the delivered bid, you may request a full refund within 7 days of delivery, provided that:

• check_circle You provide a written explanation of why the output did not meet your requirements.

Refunds are processed via the original payment method and typically appear within 5-10 business days. We reserve the right to refuse refund requests that are frivolous or made in bad faith.

7. Intellectual Property

Upon full payment, the Client owns all intellectual property rights in the generated bid output. You are free to use, modify, and submit the output as you see fit.

You retain all rights to the documents and materials you upload to the Service. We do not claim any ownership of your uploaded content. We will not use your uploaded documents or generated outputs to train our AI models or for any purpose other than fulfilling your order.

The SwiftBid platform, brand, software, and underlying technology remain our intellectual property and are protected by applicable copyright and trademark laws.

8. Limitations of Liability

To the maximum extent permitted by law, SwiftBid shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of contracts, or loss of business opportunity, arising from or in connection with your use of the Service.

Our total aggregate liability in respect of any claim arising from or in connection with the Service shall not exceed the amount paid by you for the specific bid order giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

9. Data Handling

Your use of the Service is also governed by our Privacy Policy, which details how we collect, process, and protect your personal data.

All uploaded documents and generated outputs are permanently deleted 30 days after delivery. We employ encryption in transit (TLS) and at rest (AES-256) to protect your data. For full details, see our Security page.

10. Termination

You may close your account at any time by contacting us at support@swiftbid.co.uk. Upon account closure, we will delete your personal data in accordance with our Privacy Policy, subject to any legal retention obligations.

We reserve the right to suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the Service in a manner that could harm SwiftBid or other users. We will provide reasonable notice where practicable.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
